Terms and Conditions for using Logwave.com.

1. Scope

1.1 These Terms of Service apply to the provided services and contents of Logwave.com. The services are offered on the Internet pages of Logwave.com. accessible through the Internet address "http://www.logwave.com/".

2. Users, Registration

2.1 The Logwave.com services are available to natural persons aged 13 years or older.

2.2 The Logwave.com services are designed for private, non commercial usage. If a member of Logwave.com uses the Logwave.com services for commercial and professional reasons this happens on the user's own risk. Logwave.com cannot be held liable for potential loss and damage; however, the user is obliged for compensation to Logwave.com for potential loss and damage.

2.3 Prerequisite for using the service is a one time registration with Logwave.com whereby the user creates a personal account.

3. Object of agreement

3.1 The Logwave.com service allows the user to store, save, send, transmit messages, data and other kind of digital contents.

3.2 As far as the user of Logwave.com is authorized to store content on the server of Logwave.com, Logwave.com has the rights to define the terms of conditions of the storage.

3.3 As far as the user of Logwave.com is authorized to enable third parties to use the stored data, the following additional terms apply:

3.3.1 Services are differentiated between a "public" and "non public" (member) area. The public area is accessible to everyone by entering the corresponding "URL", the "non public" area is only accessible to members of Logwave.com.

3.4 Service component of every Logwave.com account is a newsletter sent to the user's Logwave.com Inbox. The user can not unsubscribe the newsletter other than terminating the account.

4. Accomplishment of the contract

4.1 The registration to Logwave.com happens by accepting the Terms of Service of Logwave.com by the user. By this the user is authorized to use all Logwave.com services.

5. Fees and additional costs

5.1 All Logwave.com services can be used free of charge.

5.2 In order to use Logwave.com access to the Internet is necessary. This however is not part of the service of Logwave.com. Therefore this might cause costs. The user is responsible for those costs.

6. Copyright and intellectual property

6.1 The Logwave.com website and the Logwave.com services are protected by applicable intellectual property and other laws. The illegal duplication, distribution, copying or publication of the Logwave.com website or its contents will be prosecuted by Logwave.com.

6.2 Only such messages, contents and data are allowed to be saved on the Logwave.com servers which do not violate third party copyrights and intellectual property rights.

7. Rights and responsibilities of the user

7.1 Each user of the Logwave.com service is fully acountable for his activities by using Logwave.com. Patricularly this applies to uploaded messages, contents and data stored on the Logwave.com servers.

7.2 The user is not allowed to use any of the Logwave.com service improperly especially it not not allowed to transmit or distribute messages, contents and data deliberately or negligent via the Logwave.com services.

It is prohibited to send unrequested messages, contents and data and any other form of advertising or marketing messages (i. e. Spam) to Logwave.com members or by using the Logwave.com service.

7.3 User activities that are aimed to disable or complicate the usage of the Logwave.com Web site or services are prohibited.

7.4 The user is obliged not to upload, store and distribute messages, contents and data that is illegal, unlawful, harmful, threatening, abusive, harassing, hateful, racially, or pornographic.

8. Rights and responsibilities of Logwave.com

8.1 When breaching or violating against the Terms of Service of Logwave.com you agree that Logwave.com is authorized to:

8.1.1 immediately delete uploaded, stored, sent and received messages, contents and data without prior notice

or

8.1.2 immediately fully terminate the account without prior notice.

9. Liability

Logwave.com can not be held liable for any loss or damage of data. It is therfore the responsibility of the user to make backups of the uploaded, stored and received messages, contents and data.

10. Termination

10.1 Logwave.com is authorized to change, restrain or terminate parts of the Logwave.com services as well as the Terms of Service without giving reasons.

10.2 The user and each authorized third party person is entitled to discontinue the usage of the Logwave.com services at any time.

10.3 Logwave.com is also authorized to terminate a users Logwave.com account with immediate effect if the user does not use the Logwave.com service for six month in a row.

10.4 In the case of termination of the users Logwave.com account Logwave.com will delete the account and all related data with effect of the termination.

11. Data protection

11.1 Personal data collected by Logwave.com will only be used by Logwave.com as long they are mandatory to accomplish the contract or Logwave.com is legally bound to process the data. Logwave.com points out that all personal data is processed electronically.

11.2 Logwave.com will not analyze transmitted, uploaded and stored messages, contents and data nor will Logwave.com make this data available to third parties unless legal requirements binds Logwave.com to do so.

11.3 Logwave.com is authorized to use anonymous user information to

11.3.1 create statistics and conduct market research

and

11.3.2 provide third parties demographic data about Logwave.com users.

11.4 All saved data will be deleted with effect of the termination unless statutory provisions do not allow to do so.
